Having your Polish citizenship confirmed is only half the journey to an EU passport. Before Poland will issue you a passport, your foreign birth and marriage certificates must be entered into the Polish civil registry. This step is called civil record transcription (umiejscowienie aktu)<\/strong>, and it is where many otherwise solid applications stall, usually over a misspelt name or a missing document.<\/p>\n Transcription means copying the content of a civil status record issued abroad into the Polish civil registry. It is governed by the Civil Status Records Act (ustawa Prawo o aktach stanu cywilnego)<\/strong> of 28 November 2014, which replaced the older term transkrypcja<\/em> with umiejscowienie<\/em>.<\/p>\n The foreign record is reproduced faithfully and literally. Once this is done, you hold a Polish civil record<\/strong> from which full copies and extracts can be issued, exactly as for a citizen born in Poland.<\/p>\n Transcription normally comes after<\/strong> the confirmation of Polish citizenship (potwierdzenie posiadania obywatelstwa polskiego)<\/strong> issued by the Mazovian Voivode, since that decision establishes that you are a Polish citizen. In practice, a Polish birth record is then the gateway to:<\/p>\n If you are married, your marriage certificate usually needs to be transcribed too, especially if your surname changed. The same applies to your minor children’s birth certificates if you wish to pass citizenship on to them and obtain their passports.<\/p>\n Certificates issued in another EU Member State benefit from Regulation (EU) 2016\/1191<\/strong> on public documents, which removes the apostille requirement between Member States and allows a multilingual standard form that can, in some cases, replace a translation. Certificates from the United States, the United Kingdom, Israel or other non-EU countries do not benefit from this regime, and the apostille requirement is assessed by the registry office handling the case.<\/p>\n Because transcription is literal, names are copied as they appear on the foreign record. This is the source of most difficulties:<\/p>\n The law provides separate tools to deal with this: supplementing the record (uzupe\u0142nienie aktu)<\/strong> when data is missing, such as the mother’s maiden name; correction (sprostowanie aktu)<\/strong> when there is an error; and, under certain conditions, adapting the spelling (dostosowanie pisowni)<\/strong> to Polish rules. These requests are best prepared alongside the transcription so that your passport is issued under the correct name.<\/p>\n The head of the USC may refuse transcription, in particular where the authenticity of the foreign document is not established or the record was not issued by a competent authority. A refusal takes the form of an administrative decision (decyzja)<\/strong>, which can be appealed to the Voivode and then to the Voivodeship Administrative Court (WSA)<\/strong>. Appeal deadlines are short and are stated in the decision, so act promptly.<\/p>\n Do not confuse this with the reconstruction of a record (odtworzenie aktu)<\/strong>, which concerns a pre-war Polish record that was destroyed or lost, such as a grandparent’s. That is a separate procedure, closer to proving descent than to transcription.<\/p>\n Transcription looks purely administrative, yet it permanently fixes your identity in the Polish civil registry. A name inconsistency across generations, an imprecise translation or a missing document can delay your PESEL number and passport, or require a correction procedure later.
